ASA upholds complaint against Orange
The Advertising Standards Authority (ASA) has adjudicated on a complaint about an Orange broadband advert.
T-mobile complained that the ad’s wording “unlimited UK and international calls to 100 countries” was misleading as there was a fair use policy (not mentioned in the advert) of 1000 minutes a month. Additionally, the ad mentioned “unlimited downloads” which were also subject to a fair use policy (also not mentioned).
Orange pointed out that only a small percentage of users was affected by the fair use policies, and the ASA agreed that because of that, a foonote about the fair use policies would be enough. Orange also claimed that not including the fair use policies in the ad was a simple error and that, in future, reference to fair use policies would be included in the ad.
However the ASA upheld the complaint – and pointed out that Orange had missed off such references twice in the past due to errors, and had on those occasions asured the ASA they would include such references in future.
